Settlement Requirements For Solicitors Settling
By Direct Credit With Facsmile Confirmation





If you intend settling with us by using a direct credit to our trust account followed by facsimile confirmation then please note that we require the following procedure to be observed. 

 1. Attached to this Memorandum are two pre-encoded deposit slips for our trust account held with the National Bank Otahuhu Branch Account Number 060241 0154844 00.

2. On settlement please complete the deposit slip in duplicate and lodge the required amount to settle to the credit of our trust account by BANK CHEQUE at any branch of the National Bank of New Zealand Limited.

3. Please then send us by facsimile copies of the Bank cheque and the stamped duplicate deposit slip with your undertaking as follows:

"re……………………………………."

We personally undertake that we have paid into your trust account with the National Bank of New Zealand Limited at Otahuhu at …….am/pm today the sum of $……………………by bank cheque as evidenced by the attached photocopies. This payment is made in settlement of the above transaction.

4. We undertake that on receipt of confirmation of payment as above we shall forthwith make payments necessary to obtain the relevant documents of title and forward the same to you.

5. We require the funds to be deposited to our trust account and the facsimile confirmation dispatched to us PRIOR TO 3:30pm.

6, Any variation to the above settlement procedure will need to be confirmed with us prior to settlement.

7. Following receipt of the settlement monies we will forward you the settlement documents through the Document Exchange or by ordinary post if you are not a member of the Document Exchange. This is on the basis that the documents are at your risk immediately we place them in the Document Exchange or the mail box. If the documents are lost in transit and are not received by you, the cost of replacing them must be borne by you or your client.

8. Should you fail to meet these settlement requirements as outlined above, settlement shall be deemed not to have been effected and we reserve the right to charge interest in terms of the agreement until settlement is effected in accordance with the agreement.

9. If you are unwilling to comply with the above procedures then the alternative is to settle at our office personally or through an Agent.
